O Muslims! Do We Have An Excuse?

The Palestine-Israel Conflict is almost a hundred years old, although it intensified with establishment of Zionist Jewish State in 1948. It is impossible for a common man in the streets of the Muslim world to not get effected by this crisis. The Gaza Jihad started on 7th October 2023 has severely affected the sentiments of the Muslims. This is an English translated “Fatwa” a religious dictum; issued by scholars of Palestine for the readers of Bangbox Online.

100 of the nation’s senior scholars issue a surprising fatwa regarding the position on what is happening in Gaza.. More than 100 scholars and preachers, led by the scholar Sheikh Muhammad al-Hasan al-Dado and the head of the Palestinian Scholars Association in Gaza, Dr. Marwan Abu Ras, a global appeal under the title: “Al-Aqsa Call and Gaza”

 

This call is extremely important and it is important to read it and understand its terminology. It is commensurate with the size of the battle and the size of the attack on the nation. It is a strict and resolute call, beautiful in meaning and structure.

 

May God accept from us and from them and inspire the nation with its guidance.

 

In the name of God, the most gracious, the most merciful

 

Al-Aqsa and Gaza call

 

God Almighty said: (Those who hide the clear proofs and guidance that We have revealed—after We made it clear for humanity in the Book—will be condemned by Allah and ˹all˺ those who condemn.” (Al-Baqarah - 159).

 

Based on this divine mandate, and in fulfillment of the legitimate responsibility, and in advocating the truth, and striving with the word, the nation’s scholars, elites, bodies, public figures, and its broad masses from all countries, bodies, and associations declare their affirmation of the following legal constants:

 

First: Supporting the resistance

 

What the resistance is doing in the Gaza Strip to repel the aggression of the aggressors against Al-Aqsa Mosque and against all our people in Palestine is a holy jihad and is the pinnacle of the hump of Islam.

 

Second: Loyalty

 

We declare that we are loyal to the valiant Palestinian resistance, and they are of us and we are of them. We support those who support them and are hostile to those who are hostile to them, and that everyone who supports the Jews and Christians and supports them is an apostate from Islam. The Almighty said:

“Have you ˹O Prophet˺ not seen those who were given a portion of the Scriptures yet believe in idols and false gods and reassure the disbelievers1 that they are better guided than the believers? (- (An-Nisa - 51))

 

Third: The land of Palestine is an endowment, and it is not permissible to give up an inch of it

 

Liberating Al-Aqsa Mosque and taking care of it is one of the beliefs of Islam and one of the laws of God, and all of Palestine is an Islamic endowment until the Day of Resurrection, and the consensus of the nation is held on the prohibition of giving up any part of Palestine as a sale or gift to an infidel, in any way, or under any circumstances. Selling or relinquishing any part of it does not bind Muslims, whether the person disposing of it is a resident of Palestine or an authority, as his action will be returned to him and nothing will pass on the nation.

 

Fourth: Failure to support Gaza is an escape from the advance:

 

It is unanimously agreed upon that if the enemy raids them, fighting is obligatory for every Muslim country, and it is obligatory for all members of the population in that country, and it has become a specific obligation for them, in which no one is consulted, and his opinion is not taken into consideration. Whoever turns away from it or abandons it, is fleeing the advance, just as; The one who takes charge on the day of battle bears his burden to the extent that his assumption and abandonment cause him any harm or danger.

 

God Almighty said: (And whoever turns his back to them on that day, unless turning to fight or joining a group - he will certainly incur the wrath of God, and his abode is Hell. And wretched is the Destiny (16), and that if they are unable to repel the enemy, then jihad is required and obligatory on the encirclement countries that follow Palestine.

 

Fifth: Jihad against the occupiers that repels Muslims is a jihad:

 

The aggression of the Jews against Jerusalem, Al-Aqsa, and Palestine calls for Muslims to undertake a repulsive jihad, because the enemy has assaulted religion, honor, land, soul, soul, and money, and one of them is sufficient to make it obligatory for everyone who is able to mobilize and jihad. Accordingly, it is obligatory for all capable Muslims to mobilize in general in support of their brothers in Gaza, and in practice to liberate the blessed Al-Aqsa Mosque.

 

Sixth: Closing borders and crossings is a betrayal of God and His Messenger:

 

The encirclement countries must open their borders to allow the general movement to come and go for the Mujahedeen, and provide relief to those in need, especially the Rafah crossing, as it is the lifeline. It is not permissible in any way to close it in the face of those who are fleeing for the sake of God, and closing it is a betrayal of God, His Messenger (PBUH), the believers, and any of the people of the people who die. Without first aid in Gaza, the one who closed the crossing and prevent assistance is considered to have caused death by abandoning it, and this is one of the agreed-upon reasons for the guarantee. It is agreed that abandoning a consumer’s life or money is required for the guarantee, as those who closed the crossings guarantee the loss of lives, property and bodies to which the people of Gaza were exposed, because of this closure.

 

This is a murder that will be questioned before God Almighty, and the closure of it by an army, state, or any security apparatus is considered to be guarding the enemy and empowering them from the necks of the Muslims, and strengthening him over the brothers of the religion, and it is clear loyalty to the unbelievers.

 

Seventh: The expansion of the battlefield in the world

 

If the enemy is not deterred and immediately stops his aggression, this is considered a continuation of the aggression. Which could lead to an explosion in the situation and an expansion of the battlefield?

 

Eighth: The characteristics of occupier and civilian do not combine in one person:

 

Every usurper of Palestinian lands, occupier of its lands, and affiliated with the criminal entity is an aggressor-warrior, not a peaceful civilian, regardless of his gender or description.

 

Ninth: Public mobilization

 

It is obligatory for the Muslim masses to mobilize, each with what they can, and to clash with the enemy by all available means, or to go to the enemy’s embassies and supporters to protest.

 

Tenth: Boycott

 

It is necessary to boycott the products and goods of the criminal entity and all the companies, factories and countries that support it, and it is forbidden to buy from them or deal with them, as a form of economic jihad.

 

Eleventh: All peace and normalization agreements concluded with the entity before this attack on Gaza, including international agreements and treaties, are invalid and have no legal value. It is stated in the two Sahih books that the Messenger (PBUH) said: The obligation of Muslims is one, and the lowest of them strives to fulfill it. Whoever betrays a Muslim, the curse of God, the angels, and all of mankind will be upon him, and no justice or compensation will be accepted from him on the Day of Resurrection. Accordingly, any attack on any Muslim by a covenant or non-Muslim person violates his covenant, and this is a matter of consensus among Muslim scholars.

100 من كبار علماء الأمة يصدرون فتوى مفاجئة بشأن الموقف مما يجري في غزة.. نص الفتوى

أصدر أكثر من 100 عالم وداعية على رأسهم العلامة الشيخ محمد الحسن الددو ورئيس هيئة علماء فلسطين بغزة د. مروان أبو راس، نداء عالميا تحت عنوان:

“نداء الأقصى وغزة”

هذا النداء غاية في الأهمية ومن المهم قراءته وفهم مصطلحاته، وهو يتناسب مع حجم المعركة وحجم الهجمة على الأمة، نداء صارم وحازم، جميل في المعنى والمبنى.

تقبل الله منا ومنهم وألهم الأمة رشدها.

بسم الله الرحمن الرحيم

نداء الأقصى وغزة

قال تعالى: ( إِنَّ ٱلَّذِينَ يَكْتُمُونَ مَآ أَنزَلْنَا مِنَ ٱلْبَيِّنَٰتِ وَٱلْهُدَىٰ مِنۢ بَعْدِ مَا بَيَّنَّٰهُ لِلنَّاسِ فِى ٱلْكِتَٰبِ ۙ أُوْلَٰٓئِكَ يَلْعَنُهُمُ ٱللَّهُ وَيَلْعَنُهُمُ ٱللَّٰعِنُونَ) ( البقرة – 159).

انطلاقاً من هذا التكليف الرباني، وتنفيذاً للمسؤولية الشرعية، وصدعاً بالحق، وجهاداً بالكلمة، يعلن علماء الأمة ونخبها وهيئاتها وشخصياتها العامة وجماهيرها الواسعة من كل الأقطار والهيئات والروابط، تأكيدهم على الثوابت الشرعية التالية:

أولاً: تأييد المقاومة

إن ما تقوم به المقاومة في قطاع غزة لدفع عدوان المعتدين على المسجد الأقصى وعلى كل شعبنا في فلسطين، هو جهاد مقدّس وهو ذروة سنام الإسلام.

ثانيا: الموالاة

نعلن أننا موالون للمقاومة الفلسطينية الباسلة، وهم منا ونحن منهم، نوالي من والاهم ونعادي من عاداهم، وإن كل من والى اليهود والنصارى وظاهرهم على المسلمين، فهو مرتدّ عن الإسلام، وقد قال تعالى: ۞ يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَتَّخِذُوا الْيَهُودَ وَالنَّصَارَىٰ أَوْلِيَاءَ ۘ بَعْضُهُمْ أَوْلِيَاءُ بَعْضٍ ۚ وَمَن يَتَوَلَّهُم مِّنكُمْ فَإِنَّهُ مِنْهُمْ ۗ إِنَّ اللَّهَ لَا يَهْدِي الْقَوْمَ الظَّالِمِينَ ( – (النساء – 51)

ثالثاً: أرض فلسطين وقف لا يجوز التنازل عن شبر منها

وتحرير المسجد الأقصى والعناية به عقيدة من عقائد الإسلام وشريعة من شرائع الله، وإن فلسطين كلها وقف إسلامي إلى يوم القيامة وإجماع الأمة منعقد على حرمة التنازل عن أي جزء من فلسطين بيعًا أو عطاءً لكافر، على أي وجه من الوجوه، أو تحت أي ظرف من الظروف، وإن البيع أو التنازل عن أي جزء منها لا يٌلزم المسلمين، سواء كان المتصرف من سكّان فلسطين أو ذا سلطة، فتصرفه مردود عليه ولا يمضي على الأمّة في شيء.

رابعاً: التقاعس عن نصرة غزة فرار من الزحف:

من المجمع عليه أن كل بلد من بلاد المسلمين إذا داهمهم العدو وجب القتال، وتعين على جميع أفراد السكان في هذا البلد، وأصبح فرض عين في حقهم لا يستشار فيه أحد، ولا يؤخذ برأيه، فمن تولّى عنه أو تركه فهو فارُّ من الزحف، كما أن المتولي يوم الزحف يتحمل وزره بقدر ما يتسبب فيه توليه وتخليه من أضرا وأخطار.

قال تعالى: ( وَمَن يُوَلِّهِمْ يَوْمَئِذٍ دُبُرَهُ إِلَّا مُتَحَرِّفًا لِّقِتَالٍ أَوْ مُتَحَيِّزًا إِلَىٰ فِئَةٍ فَقَدْ بَاءَ بِغَضَبٍ مِّنَ اللَّهِ وَمَأْوَاهُ جَهَنَّمُ ۖ وَبِئْسَ الْمَصِيرُ (16)) ، وأنهم إذا عجزوا عن رد العدو، فقد تعين الجهاد ووجب على دول الطوق التي تلي فلسطين.

خامساً: جهاد المحتلين جهاد دفع متعين على المسلمين:

عدوان اليهود على القدس والأقصى وفلسطين يستدعي أن يقوم المسلمون بجهاد الدفع، لأن العدو قد اعتدى على الدين والعرض والأرض والنفس والروح والمال، وواحدة منها كافية لوجوب النفرة والجهاد على كل مستطيع، وعليه فإنه يجب على جميع المسلمين القادرين النفير العام نصرة لإخوانهم في غزة، وعملًا لتحرير المسجد الأقصى المبارك.

سادساً: إغلاق الحدود والمعابر خيانة لله ولرسوله:

يتعين على دول الطوق أن تفتح حدودها لعبور النفير العام، ودخول المجاهدين، وإغاثة المحتاجين، وخاصة معبر رفح فهو شريان الحياة، ولا يجوز بأي شكل من الأشكال إغلاقه في وجه هؤلاء النافرين في سبيل الله، وإن إغلاقه خيانة لله ورسوله وللمؤمنين، ومن يمت من أهل غزة دون إسعافه يعتبر مغلق المعبر ومانع المساعدة متسببًا في الموت بطريق الترك، وهذا سبب من أسباب الضمان المتفق عليها، فمن المتفق عليه أن ترك تخليص مستهلك من نفس أو مال موجب للضمان، حيث يضمن المغلقون للمعابر الخسائر في الأرواح والأملاك والأجساد التي تعرض لها أهل غزة بسبب هذا الإغلاق.

وهذه جريمة قتل سيُسأل عنها أمام الله سبحانه، وقيام جيش ما، أو دولة أو أي جهاز أمني بإغلاقها يعتبر حراسة للعدو وتمكينًا له من رقاب المسلمين، وتقوية له على إخوة الدين، وهو موالاة واضحة للكافرين،

سابعاً: اتساع رقعة المعركة في العالم

إذا لم يرتدع العدو ويتوقف فوراً عن عدوانه، فإن ذلك يُعد إمعانا في الاعتداء؛ ما قد يؤدي إلى انفجار الأوضاع واتساع رقعة المعركة.

‏ثامناً: لا تجتمع صفة المحتل والمدني في شخص واحد:

كل مغتصب للأراضي الفلسطينية، محتل لديارها، منتسب للكيان المجرم، فهو معتد محارب، وليس مدنيا مسالماً، أياً كان جنسه أو وصفه.

تاسعاً: النفير العام

وجوب النفير العام على جمهور المسلمين كلٌ بما يستطيعه، والاشتباك مع العدو بكل الوسائل المتاحة، أو النفير إلى سفارات العدو وداعميه للاحتجاج

عاشراً: المقاطعة

وجوب مقاطعة منتجات وبضائع الكيان المجرم وكل الشركات والمصانع والدول الداعمة له، وحرمة الشراء منهم أو التعامل معهم، كصورة من صور الجهاد الاقتصادي.

الحادي عشر: كل اتفاقيات السلام والتطبيع التي عقدت مع الكيان قبل هذا الاعتداء على غزة، بما في ذلك الاتفاقيات والمعاهدات الدولية، باطلة شرعًا لا اعتبار لها، فقد ورد في الصحيحين أن الرسول صلى الله عليه وسلم قال : ذِمَّةُ المُسْلِمِينَ وَاحِدَةٌ، يَسْعَى بهَا أَدْنَاهُمْ، فمَن 9أَخْفَرَ مُسْلِمًا، فَعليه لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ، لا يُقْبَلُ منه يَومَ القِيَامَةِ عَدْلٌ، وَلَا صَرْفٌ. وعليه فإن أي اعتداء على أي مسلم من طرف معاهد أو ذمي ينقض عهده، وذلك محل إجماع من علماء المسلمين.
